MEETING WITH CHAIRMAN CHIEFS OF STAFF COMMITTEE

Thanks to a Course Mate, Air Chief Marshal NC Suri (Retd), a meeting was arranged for me with Air Chief Marshal Arup Raha, PVSM, AVSM, VM, ADC (Chairman COSC & CAS) on 27 Aug 2014 at Air HQ. The objective was to convey the anxiety and concern with which the ESM are awaiting the executive actions of the Govt despite Supreme Court orders on a number of issues concerning them and the lack of any evident activity on the issue of OROP, despite commitments by the PM. I also conveyed that ESM are deprived of information and the Service HQ must devise a method of disseminating information concerning them, especially through their websites. I also conveyed the feeling amongst the ESM that senior officers do not appear to pay much attention to the negative attitude of certain elements of the bureaucracy which result in the serving personnel being deprived their dues. In the 30 minute meeting the following points were made:-

(a)  The three Chiefs are working together to see that the defence services get their due, and consequently the ESM.

(b)  The PM and RM are very receptive and the Chiefs have the opportunity to meet them regularly every month/week. During these meetings, personnel and equipment issues are brought up. The infirmities in the interpretation of Supreme Court orders has been brought to their notice and action is being taken to ensure that all the four issues concerning the SC orders are resolved soonest. Two of them have already been resolved; the other two will also be resolved soon.

(c)  All three Service HQ will be advised to devise means to update their websites and provide relevant information.

(d)  OROP is still under consideration and the Services are insisting on the Koshiyari Committee definition being adhered to. On a suggestion being made by me that the Govt pays pensions as per the definition, for the first quarter and work out the total amount required for the year. He said that the RM is pursuing the matter vigorously and expects it to be resolved soon. It was conveyed to the Chairman COSC that we had expressed our lack of confidence in the civil servants being objective in resolving OROP to the RM in our meeting with him. The findings of Air Mshl S Savur through RTIs of duplicitous action of the bureaucracy were conveyed to him. He said that the Chiefs have approached the 7th CPC to resolve the anomalies of the 4th to 6th CPC and then only decide on the pay structure of defence forces. The Commission has also been suggested that orders issued to implement the CPC award must be vetted by it and only then should it consider its work being complete.

(e)  The Chairman COSC also gave the welcome news, when I apprised him about the persistent degradation of our status, that there is a term of reference in the 7th CPC orders that historical parities be taken into consideration for determining the pay structure.

(f)  The Chiefs have taken up that DPSUs, R&D and technical Govt Depts which are manned by generalists must be manned by professionally competent personnel of the defence services to ensure optimum performance.
           
I came away with a sense that this team of Chiefs is working with the same objective and will not let ESM down. I am grateful that the Chairman COSC could spare so much time and took our concerns on board.

Subject: – Simplification of Pension Procedure- Amendment in para 15 and para 16 of “Scheme for payment of pensions to Central Govt. Civil Pensioners by Authorised Bank”.

1. Attention is invited to the provisions contained in paras 15 and 16 of the Scheme Booklet regarding submission of life & other certificates and inter bank /intra bank transfer of pension account.

2. Keeping in view the need to make the process of submission of certificates user friendly and in line with the technological advancement in the banking industry, it has been decided to allow pensioner/family pensioner to submit the life certificate as well as other certificates to any branch of the Bank through which his /her pension/family pension is being disbursed.

3. Further with the introduction of CBS and implementation of CPPC, the pensioner/family pensioner who is desirous of transferring his/her pension account from one branch to another branch (whether local or outstation) of the same bank has the option of putting in his/her request at either of the two branches instead of the present dispensation wherein transfer request is entertained only at the home branch. The transfer application will require mentioning both account numbers (in the old & new branch) with both branch contact details. The branch receiving the application will scan and register the same to CPPC. CPPC will coordinate the continuity of disbursement of monthly pension/family pension without any break.

 4. All banks are hereby directed to follow the above procedural modifications in pension process and issue necessary instructions to all concerned accordingly.

5. This issues with the concurrence of Department of Pensions & Pensioners Welfare, Ministry of Personnel, Public Grievances & Pensions and Department of Expenditure, Ministry of Finance.

Interactions with 7 CPC on 24 Aug 14 and 25 Aug 14 at Bangalore

1.   Col Rajan was informed by the GOC, Sub-Area that the Seventh CPC was scheduled to visit Bangalore from the 24 - 26 Aug 14. Accordingly, he tried to get a slot so that the ESM from Bangalore could be given an opportunity to meet this august body to convey their views on the 7th CPC. In the afternoon of 24th Aug, Col Rajan was informed that a slot would be given for 15 minutes from 1730 hrs, the same day. Due to the short notice, Rear Adm Alan O'Leary and Col Rajan were able to attend the meeting as Air Marshal Savur was out of Station.

2.   For the record, on 24 Aug 14 evening, RAdm O’Leary (Retd) and Col Rajan (Retd) met the following:-

(a) Justice (Retd) A K Mathur (Chairman)

(b) Shri Vivek Rae, Member CPC

(c) Smt Meena Agarwal, Member -Secretary

(d) Shri Samir Sinha, Jt Secy, attached to the CPC.

(e) Shri Jayant Sinha, Jt Secy, attached to the CPC

(f) Shri Sudhir Sharma, Under Secy attached to the CPC.

3. The following points were placed before the 7th CPC on 24 Aug 14: -

3.1. Whatever be the Pay & Allowances that is granted to the All India Services based on length of service, the same Pay & Allowances be granted to personnel of the Armed Forces with corresponding length of service plus (+) X factor on account of risk attendant to Military Service.

3.2. Review of the present Allowances & Benefits to those bestowed with gallantry Medals, viz. like free air travel, etc. The cash awards to gallantry need to be increased substantially, to make the allowances & benefits meaningful.

3.3. Recommendations/Award by the 7thCPC must be unambiguous, ie. so worded that there is absolutely no room for any ambiguity that can be mis-interpreted by the those implementing the orders in Ministry of Defence and those providing financial concurrence in Ministry of Finance; a classic example being grant of ‘Rank Pay’ to Officers by the 4thCPC w.e.f 01.01.1986.

3.4. Every CPC has said that when it comes to Pay & Allowances, the personnel of the Armed Forces must enjoy a slight edge vis-à-vis All India Services. That being so, Grade Pay & Military Service Pay must be clubbed together with the Basic Pay, while fixing the new Pay Scales in respect of the Armed Forces’ personnel.

3.5. Rear Adm Alan O'Leary brought out that most of the anomalies in the last Pay Commission resulted because the Sixth CPC did not share their recommendations with the PARC, before submitting their report. Therefore he suggested, that this be done in the Seventh CPC, and their findings are shared with the Services Pay Cells, before the report is finalised.

4. Rear Admiral Alan O'Leary, sought another slot where a larger forum headed by Air Marshal Savur could also be present. This was not agreed to, as the Chairman stated, that owing to a paucity of time they could not give another slot. Furthermore, they would be meeting the Chiefs shortly, who had already conveyed their aspirations to the CPC and that they were severely hard pressed for time.

5. The same night however, Rear Admiral Alan O'Leary received a call from Mr Samir Sinha, that a member of the Seventh CPC, Mr Vivek Rae, would like to meet him the next day. Rear Adm Alan O'Leary contacted Mr Vivek Rae and a meeting was fixed with a larger forum of ESM at 1730 Hours.

6. On 25 Aug 14, the meeting commenced at about 1720 hrs. Lt Gen Kamat, RAdm O’Leary, Col Rajan, Air Mshl Savur and Col Srikantha Seshadri, (all retd, names in alphabetical order) met Shri Vivek Rae, Member, and Shri Jayant Sinha Joint Secretary 7th CPC & coordinator for Defence Services matters. The following points were placed before them for wider consultation and consideration: -

6.1. Pay

6.1.1. Pay for Armed Forces Officers should be determined at par with the AIS and Group A organised Services, as per length of service.

It was elucidated that in the Armed Forces the date of Commission is the date recorded for length of Service, whereas with the AIS, it is the date they join the Academy. The ESM proposed that the length of service needed to be rationalised in line with the practice followed by the Civil Services, as all Officers leaving the various Academies in the Armed Forces are Graduates and therefore their service could be counted from the date they pass out of these academies that could be stipulated. 

6.1.2. The so-called disparity in ages of joining respective services should not be a factor for debate or argument because the qualifications have been laid down by the Government of India i.e. the age group and minimum educational qualifications for All India Services and Defence Forces. Nevertheless, every cadet passing out of NDA is now a Graduate and CDSE requires only Graduates, just like for the All India Services.

6.1.3. While a Defence Services personnel –OR, JCO or Officer – may join at a younger age compared to their civilian counterparts, they also retire/get discharged/superannuate at lesser age(s) commensurate with the rank attained. On the other hand all civil services employees superannuate at 60 years of age, unless they choose to seek greener pastures earlier.

6.1.4. Ranks in the Armed Forces be delinked from the Warrant of Precedence, as there is no commonality with any civil service that have different hierarchical structures. The governing factor should be length of Service and that alone.

6.2. Allowances

6.2.1. Allowances should be at par with Civil Services employees i.e. if AIS are entitled to X allowance for service in an area, then the same amount of allowances should be the entitlement of Defence Personnel.

Also the date of commencement of new allowances for all class of employees, Civilians or Defence Forces would be the same.

6.2.2. For example Instructional allowances at a certain percentage is paid to Civil Services and similar allowances should be paid to Defence Forces personnel. It was suggested that Services HQ should identify the training institutions where this allowance would be applicable.

6.3. Non-Functional Upgradation

6.3.1. The ESM emphasised that there was no justification for Armed Forces Officers to be left out of NFU, that the Sixth CPC had granted to all AIS Officers and Group A organised Services. They reiterated that pay promotions would have absolutely no impact on the Command and Control equations that existed in the Armed Forces and this should be implemented from 1 Jan 2006.

6.3.2. The members of the 7th CPC were shown true typed copies of the MoD’s replies dated 08 Oct 13 and 30 Dec13 to RTI that MoD has reviewed recommendation by the Committee of Secretaries in respect of NFU for Defence Services officers and has “decided to wait” and that the NFU is under consideration of the Government and hence information cannot be shared, respectively.

6.3.3. Shri Rae desired that scanned copies of the MoD’s reply may be emailed to Shri Jayant Sinha, JS to 7 CPC & coordinator for Defence Services matter. The scanned copies have been mailed to Shri Jayant Sinha on 26 Aug 14.

The meeting ended at 1900 hrs.

Dear Friends

We had our Governing Council meeting on 21 Aug. All the members were deeply disturbed to know what was going on about OROP. In anguish they passed a RESOLUTION and desired that I conveyed their feelings to the Hon'ble PM, so that he takes timely corrective action to avert this impending disaster.

What we have on mind is that we try all means to meet up with the authorities and try to have it implemented by 31 Dec 2014. If it does not, then we prepare for making more sacrifices to win the leadership over for granting us OROP. For this our members would undertake indefinite fast starting end of Feb 2015. The program would be a repeat of 1987, when our fast lasted 17 days and was ended on the direct intervention of the Hon'ble PM himself.
The RESOLUTION and the letter to the PM follow. Also given below is the paper distributed to members, giving in simple words the situation that prevails today.

We invite all Veterans Organizations to join up and make this a final push. Depending upon your response we will proceed further.

LETTER TO THE HON'BLE PRIME MINISTER DATED 21 AUG 2014



Respected Narendra Bhai Saheb,

You were very kind to promise to fulfill the long standing demand of OROP of Veterans on coming to power. Your first action to restate your commitment by the President during the Joint Session of Parliament was very reassuring. Hearing that, the bureaucrats who have successfully stalled its implementation for over 33 years, got into action again.

In our Governing Council Meeting held in Delhi on 21 Aug the present position with regard to grant of OROP was explained.

It was a matter of deep shock for all present to know that despite your commitment the Bureaucrats are out to deny us our rightful due. They were in agony to know what was going on and then went on to pass the attached RESOLUTION which they wanted me to convey to you so that you could take preventive action to ward off this disastrous situation.

Many volunteers got up to make supreme sacrifice if the OROP did not come through even with a leader like you at the helm. We have no doubt that you will not let this happen.

GRANT OF ONE RANK ONE PENSION

RESOLUTION

GENERAL

Past History

We have been struggling for the last 33 years for the grant of ONE RANK ONE PENSION (OROP) for Veterans. Down the line five Prime Ministers starting with Indiraji had accepted to give it. All their benign gestures to grant the Veterans their rightful dues were however frustrated by the hostile bureaucracy.

Recent Commitments

Now the Sixth Prime Minister had announced its acceptance in the Parliament on 17 Feb 2014. The seventh Prime Minister Sh Narendra Modi had given his commitment even before he assumed the charge. After assuming charge he reiterated his commitment through Presidential address to the joint session of the Parliament.

Bureaucratic Opposition

The bureaucrats are out to frustrate the commitment of Sh Narendra Modi also. They first produced their own version of OROP, which was rejected with the contempt it deserved. When they were given the correct definition, they worked out Rs 9100.00 crore as expenditure to scare the leadership into reneging from their commitment.

Parting Shot

A delegation of Veterans met the Hon'ble RM on 16 Jul 2014. After the meeting when they were leaving, as a parting shot, the Hon'ble RM told them that they should lower their expectations. In other words we should not hope to get true version of OROP. A time has come when unless the Hon'ble PM takes appropriate action he was also likely to fail as his illustrious predecessors.

RESOLUTION

We therefore unanimously resolve to appeal to Sh Narendra Modi our respected Prime Minister, 
(a) to take matters in his own hands and fulfill his promises made at Rewari to grant OROP to the Veterans on coming to power, as the Bureaucrats who have short changed us for the last thirty three years are not going to let it happen so easily;
(b) we further submit that we shall be waiting for its implementation until 31 Dec 2014. If it does not come through we shall know that the Hon'ble Prime Minister, our respected leader, is not satisfied with the sacrifices already made by the veterans for the Nation. We shall then make a few more with the hope that he would be won over into fulfilling his promises.

CONCLUSION
During recent Elections wherever the Hon'ble PM went, he asked the public whether the previous Govt fulfilled their promises to them? When the public answered NO, he told them to throw the Govt out , which they did with a vengeance unheard of before. We are sure that the dedicated and effective leader that he is, he would not allow the bureaucrats to land him in similar situation.

HAND OUT GIVEN TO MEMBERS

OROP Sanctioned

We have been seeking the grant of OROP ever since 1982 when we put this up to Smt Indiraji first time ever. Thereafter we got this approved by last five Prime Ministers which included Sh Rajiv Gandhi, Sh VP Singh, Sh Narasimha Rao, Sh IK Gujral, Sh Atal Bihari Vajpayee.

After a meeting of Lt Col Inderjit Singh Chairman with the leadership on 14 Feb 2014 the Sixth PM finally announced its acceptance on 17 Feb 2014. The Govt appointed a committee to work out the award so that it could be implemented before the elections were declared. In Apr a meeting of this Committee was held in which MOD produced their version of OROP, which was rejected by the Services. They then asked the Services to put up their own proposal. The Services HQs produced a Draft Government Letter (DGL) which has been in circulation for quite some time now.

On 12 Jun the three Services Chiefs presented this proposal to the Raksha Mantri. The MOD did not agree with it and to mislead the leadership they stated that the expenditure would be Rs 9100 crores.

With both sides disagreeing with the other the problem is stuck. A few days back a delegation of the veterans led by Gen VK Singh met the RM for moving the matters. After listening to them and before the delegation left he very clearly told them that they should "tone down their expectations". This in other words means that the Govt is not going to give full OROP.

This is where the matter rests today.

CABINET SECRETARY'S AWARD

In Sep 2012 the Cabinet Secretary's Committee increased the Veterans pensions that fell far short of OROP. Whatever was given was made applicable wef 24 Sep 2012 and not from 01 01 2006. These orders have been implemented to a large extent already. Those who have not received will also receive soon enough.

Not satisfied with this decision a case was filed by some organization for making this applicable wef 01 01 2006, which has been won by the pensioners.

LIKELY PAYMENT OF OUR DUES

As a result of various orders we are to get the following:-

a) Cabinet Secretary's award effective from 24 Sep 2012. This is in the process of disbursement. Many of us have already got it. Remaining will get it soon.

b) Cabinet secretary's award wef 01 01 2006. The Court has allowed this and sooner or later the Govt will have to pay.

c) Award as a result of implementation of OROP. This will be effective from 01 Apr 2014 and will be paid after the Govt issues orders.

Department of Personnel & Training abolishes regressive stipulation......

Many military personnel, due to early retirement, look for jobs in the government/public sector after release. Many of them apply for multiple employment opportunities, but then (till now) there was a catch. If an ex-serviceman applied for various civil posts under the ex-servicemen quota and joined one such post, he/she could later not opt for any other post under the said quota. A veteran could hence avail of it only once.

To take an example, if a person had applied for two posts, one lower and one higher, but got selected for the lower post first and joined the same, he could not then join the higher one even if he got selected for the latter since ex-servicemen quota was treated as 'exhausted' on his joining the first post.

This was of course regressive and also fortuitous and chance-based in the sense that a person was forced to join the post or the appointment where the result was declared first to avoid losing out on a job opportunity.

Actually, according to my construal, this blanket ban was based on misinterpretation of various instructions issued from time to time, but that's another story and now pales into insignificance because of the latest development.

The Department of Personnel & Training (DoPT) has now abolished this incongruous stipulation and has provided that if a person had applied for various vacancies before joining a civil employment, he/she can avail of the benefit of reservation for any subsequent employment.
This is a major move and should come as a big relief to military veterans looking for employment on the civil side.

Dear Friends

1.     It is some time that we have had a meeting. The reasons were manifold. Firstly the matters regarding our pensions were in a very critical stage. With the Elections coming in, every party in their desperate bids to win Veterans over making all sorts of promises. First Mr Modi at Rewari promised One Rank One Pension and then on 17 Feb, Congress in Parliament the grant of OROP. With this we got into action to see the Govt orders came out before the Elections. Our efforts towards this end were frustrated and we could not get the orders issued before Elections.

2.     The new Govt was formed and things started moving ahead. The Services prepared their proposals and presented the same to the Raksha Mantri on 12 Jun. The bureaucrats in their efforts to deny OROP to us brought in many problems which were not acceptable to the Armed Forces. The matter ended there. Some ESM met the RM who told them very clearly that we should cut down our demands. This means the Govt is not wanting to give what they promised. The matter stands there. We are trying to meet the authorities to move the matters.

4.      Our Governing Council Elections were held on 21 Nov 2013. As per our tradition all members were elected unopposed. List of those elected has been posted on our blog and can be seen.

5.      We will be having our Governing Council Meeting at the Community Hall Netaji Nagar New Delhi at 1100 hrs on 21 Aug 2014.. You are requested to come in large numbers and attend the meeting and give your valuable suggestions. The Agenda for the meeting is as follows:-
  • Review of the situation and work out our plan of action.
  • Future Programs.
  • Accounts.
  • Any other point with the permission of the Chairman.

AIEWA - FORAYS INTO SAMAJ SEWA

Our Association members from Vill Kheri Khumar, Distt Jhajhar, Haryana
 decided to work to improve the Quality of Life of the Veterans and Civil Population of the Village. For carrying out this work they registered a Society by the name of KHERI KHUMAR EX SERVICEMEN GRAMIN VIKAS AND WELFARE SAMITI. They held a very big function in the village for its inauguration on 27 July 2014. Lt Col Inderjit Singh, Chairman of the ALL INDIA EX SERVICES WELFARE ASSOCIATION was invited as the Chief Guest. A large number of people from the village and area around had gathered to witness the inauguration of this noble cause.

The Procession

The members organized six outriders on their motor bikes to lead the Chairman's car to the venue of the Function from his Rest House where he was staying.

Reception and Tree Planting
On reaching the Venue the Chairman was received by the president SM Krishan Kumar, the President, Capt Jai Bhagwan Singh, the Vice President Hav Satbir Singh and a large number of members with bouquets and garlands. Before going on to the stage, the Chairman was requested to plant a tree which he did.

Remembering Martyrs
Before starting the actual proceedings two minutes silence was observed in the memory of those who sacrificed their lives for the Nation

Welcome

School children sang a few songs for welcoming the Chairman as well as songs to inspire the gathering with the valorous deeds of the martyrs. Soon after the Chairman and his Party was honoured with a Turban. There after a widow of Swatantra Sainani and a war wounded soldier were honoured and some money was given to them by the Chairman. The children who sang the songs were also given some presents by Lt Col Indejit Singh.

Sh Prabhu Dayal Spoke

He briefed the audience about the aims and ideals of the Society. These included undertaking the developmental work for the Village, fighting corruption and work for ex servicemen welfare. He also sought the blessing, guidance and support of the Chairman in their efforts at all times.

He welcomed the Chairman and sought his guidance and support in this new venture.

He thanked SM Krishan Kumar and all the members of his team for inviting him and giving him the honor to inaugurate their Society. While assuring them of his whole-hearted support he also informed them of the pitfalls for any such venture. He advised them to work for the goodwill and support of all sections of the Society with their good conduct and discipline which is part of their very being. Before closing his speech he announced Rs 5000.00 as grant from the Association.

The function ended with SM Krishan Kumar thanking the Chairman and all the guests for spending their valuable time to make the function a grand success. He also requested everybody to have lunch before going away.

CENTRAL GOVERNMENT EMPLOYEES NEWS - Expected DA from July 2014 – Finally it concludes at 7%

As anticipated by all, the expected DA from July 2014 concluded at 7%.

With the announcement of the AICPI(IW) points for the month of June, the calculation of the additional dearness allowance for central government employees and pensioners from July onwards have ended. The percentage of Dearness allowance and Dearness relief to be paid from July 2014 will be increased by 7%.

Based on the recommendations of the 6th Central Pay Commission, in order to meet the rising expenses of essential commodities and inflation, dearness allowance is given twice every year to the central government employees – from January to June and from July to December – calculated on the basis of the All India Consumer Price Index of Industrial Workers Base Year 2001=100.

The most recently released AICPIN points for the month of June have increased by two and now stands at 246. Since the AICPIN points have increased by two, the dearness allowance percentage arrived at 107.25, is to be calculated, after ignoring the decimal points, as 7%. This will be officially announced by the Central Government after approval of Union Cabinet committee in the month of September.

The last two installments, 10% dearness allowance was being paid to the employees. Many wonder why it has come down to 7% this time. There are two main reasons for this, one is AICPIN points, and another is the method of calculating DA. One has to also keep in mind the fact that dearness allowance of 10% was also given based on the same calculations.

The fact is, the next two additional dearness allowances (Expected DA from January 2015, and expected DA from July 2015) are not likely to cross 5%.

Labour Bureau, Government of India has released the All India Consumer Price Index (Industrial Workers) (AICPIN or AICPI-IW) for the Month of June 2014 as 246. There is 2 point increase in this consumer price index compared previous month. As a result, Now we have all the 12 AICPIN indices from the month of July 2013 to June 2014 in our hand now to Estimate Dearness Allowance applicable to Central Government Employees and Central Government Pensioners with effect from July 2014
